Contributor’s Collaboration Agreement
This contract is made between Destined to Publish and each Contributing Author, herein defined as the Contributor, who submits a work for inclusion in the Anthology.
- Contributor’s Grant:
The Contributor grants permission to include their story, a work of up to 2500 words, hereafter referred to as the Work, in the Anthology to be published by Destined to Publish, hereafter referred to as the Anthology. - Rights Acquired:
The primary intention of the Anthology is to promote positive, inspiring life journeys.
This use of the Work by Destined to Publish entails the assignment of anthology rights in paperback form. It is also understood and agreed that the Work will only appear in the Anthology which the author has paid to be a part of.
The Contributor will retain all other rights to their respective Work. - Contributor’s Warranties, Representations, and Indemnities:
The Contributor represents and warrants that they are the sole creator of their individual Work. The Contractor also represents that the work contains no matter unlawful in its content nor violates the rights of any third party, that the rights granted in this contract are free and clear, and that the Contributor has full power to grant such right to Destined to Publish.
The Contributor further warrants that any and all works submitted under this contract are not in the public domain and have never been published by any publishing company that may still own proprietary right to the Work.
The Contributor agrees to hold Destined to Publish harmless and indemnify it from all damages, costs, and expenses directly resulting from a finally sustained judgment relating to any legal actions incurred by the Contributor arising from a breach of the above warranties. - Contributor’s Credits, Promotional Materials, and Images:
The Contributor will be credited at the beginning of the story and will receive contributor’s credits in all copyright and ISBN registrations.
The Contributor grants Destined to Publish the right to use the Contributor’s name, image, likeness, and biographical material for all advertising, promotion, and other exploitation of the Work.
The Anthology will be published under the imprint of Destined to Publish. - Reversion of Rights:
If the Anthology is not published within four (4) months of the signing of this agreement, all rights revert to the Contributor, and the Contributor has the right to sell or arrange for publication of their individual Work in any manner.
If the Contributor fails to submit the completion of their balance prior to the release date, their writing will not appear in the anthology, and the Contributor will forfeit any moneys that have been paid. - Publishing Period, Rights Period, and Pricing:
The publishing schedule, venue of publishing, and pricing, as well as decisions regarding interior and cover designs, will be determined by the Founding Author.
